Summary of Sanibel City Council Meeting November 1, 2022
Budget Amendment 2023-001. City Council approved Resolution 22-055 to appropriate reserves and ending fund balance for personnel expenditures and revenue reductions related to Hurricane Ian, and budget the appropriate anticipated reimbursements from other governmental agencies. The amendment increases the fiscal year 2023 budget by $877,905.
Temporary Use Permits – Recreational Vehicles. Current language in the Land Development Code effectively limits the use of recreational vehicles and park trailers to Periwinkle Park. City Council approved Emergency Ordinance 22-011, to adopt a narrow provision to expand this use to all residential districts following a natural disaster. Sanibel residents who have been displaced from their homes may obtain a temporary use permit for on-site accommodations while structures damaged or destroyed by Hurricane Ian undergo necessary repairs, renovations, and/or reconstruction. The Ordinance allows only the property owner to live in the trailer on their own property for a period of 180 days. There is a provision for an extension of an additional 180 days. The trailer may only be used while the residential property is uninhabitable.
Temporary Use Permit Applications. City Council amended the Land Development Code to allow staff, rather than Planning Commission, to authorize Temporary Use Permits to help facilitate the recovery of Sanibel businesses whose commercial structures were destroyed or sustained damages from Hurricane Ian that prevent the structure from being used for business purposes. Please see Emergency Ordinance 22-012 to review all required conditions. The application process will be forthcoming from the Sanibel Planning Department.
Florida Division of Emergency Management (FDEM)
Kevin Guthrie, Director of FDEM, announced the State of Florida has assumed 100% of the cost for removal of debris from the public right-of-way. Additionally, Director Guthrie encouraged residents and property owners to apply for the state-managed program to collect debris from private and commercial properties. Residents can request removal of debris, including vehicles, vessels, motorcycles, trailers, and ATVs, through the Ian Debris Cleanup Program offered by the Florida Division of Emergency Management. For more information or to apply, visit www.IanDebrisCleanup.com Director Guthrie also announced the State of Florida has submitted a formal request for an additional 30 days of 100% reimbursement from FEMA.
Florida Department of Transportation (FDOT)
Katie Sherrard, Resident Construction Manager for FDOT, discussed the ongoing work to make permanent repairs to the Sanibel Causeway and bridge. She noted FDOT is incorporating resiliency measures into the permanent repairs. Ms. Sherrard also announced FDOT will repair the East Periwinkle Bridge. Materials have been ordered. The goal is to complete the work within two weeks after the start date.
Wastewater Utility Relief. City Council considered a recommendation from staff to provide relief to residential and commercial users of the wastewater utility system. Recognizing the sanitary sewer system was offline for the month of October, relief in an amount equivalent to month of service or average usage was recommended. The City Council will consider a resolution to approve a one-month relief to residential sewer utility customer and, a one-month relief of base meter charges for commercial customers at the December City Council meeting.
Temporary Moratorium on Processing or Issuance of Certain Development Permits or Orders. The damage resulting from Hurricane Ian requires that the city reevaluate certain land development regulations for potential amendment to facilitate appropriate reconstruction and development post-Hurricane Ian. City Council approved Resolution 22-056 to provide a 60-day temporary moratorium on the processing or issuance of certain development permits or orders, or amendments to previously approved development permits, or other zoning approvals, whether administratively or otherwise, related to certain code sections.
Temporary Moratorium on Issuance of Certain Permits for Building or Development. The Sanibel Plan provides that in the immediate recovery response post-hurricane, the priority in redevelopment permitting will be given to repair and clean-up activities needed to protect public health, safety, and welfare. In an effort to expedite review and repair efforts, City Council approved Resolution 22-057 to prioritize initial efforts seeking to repair existing structures that do not have substantial damage or require substantial improvement and place a temporary (45-day) moratorium on building permits or development permits for new construction or substantial improvement.
Elections. City Council adopted Resolution 22-047 calling for an election on March 7, 2023, setting the qualifying period for said election as noon, Monday, January 9, 2023, through noon, Friday, January 13, 2023, and designating the polling locations.
Gas Powered Leaf Blowers. City Council considered on First Reading Ordinance 22-007to amend Section 30-70 of the Code of Ordinances to change the date gas-powered leaf blowers would be prohibited in Sanibel from December 31, 2022, to June 30, 2023
Boat Ramp Pilot Program. City Council considered on First Reading Ordinance 22-008 to establish a pilot program designed to increase availability for resident parking at the city boat ramp on weekends and busy holidays.
Priscilla Murphy Center. City Council considered on First Reading Ordinance 22-009 to place the original structure Priscilla Murphy Center (1019 Periwinkle Way) on the Local Register of Historic Landmarks.
FEMA LiMWA Regulations. City Council considered on First Reading Ordinance 22-010proposing amendments to Chapter 94 (Floods) of the Sanibel Municipal Code to align with updated FEMA Flood Insurance Rate Maps (FIRM) which include the delineation of the Limit of Moderate Wave Action (LiMWA).
