Summary of Sanibel City Council Meeting December 6, 2022

Captiva Sewer Transmission Project Presentation.

Interim Public Works Director David Schmitt gave a brief background of the project and introduced consultant Fred Middle of Tetra Tech who serves as the Engineer of Record on the project. Mr. Middle provided a PowerPoint presentation regarding the project and provided a status update. Mr. Schmitt then spoke to the next steps for the project which includes an Effluent Disposal Options study that will be funded by Lee County.

Hurricane Ian Recovery Update.

Recovery Partners and staff provided updates regarding the hurricane recovery efforts to date. Mayor Smith spoke to a letter and hand mural art tapestry received from the City of Mexico Beach. Dewatering pools.

Councilman Miller spoke to concerns with property owners emptying their pools onto other properties and golf courses. Council directed Attorney Agnew to draft verbiage for issuance of a Mayor Proclamation to prohibit the dewatering of pools and spas on adjacent property, and to recommend amendments to the Code of Ordinances at a future meeting. Click here to read Mayoral Proclamation 22-13. Pool water should be discharged and retained on the same property the pool water is being discharged from.

Leaf Blowers – Extension Approver for use of Gas-Powered Leaf Blowers.  

The City Council adopted Ordinance 22-007 which provides a 6-month extension for the effective date of the prohibition of gas-powered leaf blowers. In accordance with the approved Ordinance, gas-powered leaf blowers will be prohibited after June 30, 2023.

Boat Ramp Parking.

The City Council adopted Ordinance 22-008 which authorizes a 1-year pilot program for parking and fees for Sanibel’s boat ramp facility.

Priscilla Murphy Center added to the Local Register of Historic Landmarks.

The City Council adopted Ordinance 22-009 which amends the local register of historic landmarks to include the Priscilla Murphy Center located at 1019 Periwinkle Way. 

City’s Flood Ordinance Amended based on FEMA Flood Insurance Rate Maps (FIRM).

The City Council adopted Ordinance 22-010 which updates flood regulations based on the FEMA FIRM maps which included a delineation of the Limit of Moderate Wave Action (LiMWA). This action was not related to Hurricane Ian.

Committees, Boards, Commission.

Council took no action on the Resolutions presented for reappointing members to the Planning Commission and the Contractor Review Board. Council directed staff to advertise for accepting applications, with the intent to make appointments at the January 17, 2023, meeting.

Legislative Priorities. 

By consensus, Council supported the legislative priorities presented by City Manager Souza. Mr. Souza spoke to adding the guiding principles which were included in last year’s priorities. Click here to view the Legislative Priorities.

Police Department Beach Parking Payment App. 

Police Chief William Dalton gave a brief presentation on the web-based pay application that will be used to accept future beach parking payments (daily rates). This project was in progress prior to Hurricane Ian. Click here to view the PowerPoint Presentation. Click here to view the video provided by the vendor. Council approved the recommendation to continue implementing the application.

Building Fees – Private Provider Draft Ordinance. 

Building Department Director/Chief Building Official Craig Molé briefly explained the purpose for the draft ordinance that would provide a 15% discount on some permit fees to those contractors or residents who choose to use a private provider for plan review and building permit inspections. Council directed staff to bring back for first reading at the December 20, 2022, Special City Council Meeting.

Consideration of waiving the Building Demolition Fee and reducing the Temporary Structure fee for placing a recreational vehicle or park trailer on a residential lot. 

Council approved including the waiving of the Building Demolition Fee and Temporary Structure Fee and directed Attorney Agnew to include in the mayoral proclamation. Click here to view Mayoral Proclamation 22-13.
